PAYMENT FOR TRAVELLING TIME CHALLENGED
(P.A.) AUCKLAND. June 11. The travelling time clause in the carpenters and joiners' award will be challenged in the Supreme Court on the ground that distance between Ihe place of work and an employee's norr.e is not an industrial matter. This was announced in the Arbitration Court today by Mr. L. Aldeiton, employers' counsel, in a case concerning travelling time payments He said on this point it was contended that the Arbitration Court had exceeded its powers in framing the clause. The case before the Court concerned a claim by the inspector of awards against Winstone, Limited. Wilson and Horton. Limited, and Sandford, Limited. for alleged breaches of the travelling time clause. Mr- Alderton said he had been directed to apply for a writ of prohibit ion to prevent the Court from enforcing the provision. He requested an adjournment sine die pending Tbe Supreme Court decision.
Judge A. Tyndall: If you are successful we members of the court will be in good company. Suburban works clauses have been in awards for 50 years and I think with reference to the residences of workers.’’
Replying to the judge, the inspector of awards. Mr. H. S. Hurle. said he neither agreed to nor opposed the adjournment. The court granted an adjournment.
