INDEMNITY CLAIM FAILS

A UCKLAND. August 13. A sequel lo an accident in a wharf shed in November, 1927, when Artiuir Yates, tally dark, was injured through a halo of paper striking him alier it had landed from the chute, was heard in tho Supreme Court hetoro Air 'Justice Herdman Tim Union Steam Ship Company claimed .L’3o9 ISs from James Ghevis, 'carrier" as indemnity for compensation paid to Yates, who was employed by the plaintiff company. It was stated for the plaintiff Unit the halo with which Yates was struck was sent down a chute by Chevis. It weighed about uewt, and on landing from the- upper floor of the shod it knocked Yates over. Negligence by defendant wat alleged, in that the huffm usually placed on tho cliute to prevent articles Irorn bouncing alter landing had nob been used After legal argument had been hoard, judgment was given for defendant, with costs
