NO-LICENSE AT ASHBURTON

A BREWERY PROSECUTION. ASHBURTON, December 2. At the Magistrate’s Court to-day, before Captain Wray, S.M., the Timaru Brewing Company were charged with a breach of the Alcoholic Liquors Sale Control Act, 1895- The information was laid under section 33, clause Ic, which deals with the illegality of sending into a No-Kcense district liquor which may bo intended for use. The case arose out of recent proceedings against-one Williams, who was fined £2O for keeping liquor for sale. About eighteeh gallons a week had been supplied William® for a period of two to three months. Tho defence was that it was understood that Williams was a carrier, and there was no reason to suppose he was getting the liquor for sale. The Crown Prosecutor (Mr Stringer) held that it was careless proceedings ’to supply large quantities of liqnor to an inknown man. It. was the defendant's duty to make inquiries. It had been shown that practically no inquiries had been made. In giving ’ judgment the magistrate said the quantity of liquor supplied wes a factor in tiie case. Unless the brewer knew the circumstances of the man to whom the liquor was supplied, the amount supplied would causa no suspicion. Ho thought the defendant had shown that he was not cognisant of the circumstances of the consignee of the liquor and had no raesonahle grounds to suppose that the liquor was to bo illegally sold.
