COMMERCIAL CONCILIATION.

TO THE EDITOR. Sir, —Where moral conciliation ends and immoral conciliation begins is a very subtle point to decide. A very interesting case was heard in the lung’s Bench Division in December last. The amount in dispute

was £47, a portion of the “ conciliation ’ for “ luncheons, refreshment, and entertaining.” The evidence adduced proved the necessity for such expenditure, in order to “ conciliate.” Mr Justice Ridley agreed that plaintiff’s services were well and fully rendered.

Another case is from the ‘Policyholder,' 6th November, 1901. It was considered advisable to sell an insurance company to another company. The directors were paid five years’ fees in a lump sum when their company was taken over by the purchasing one. Greed, of course, is the fruitful source of mischief. The term “ Rumfordising ” is well understood by many. One could give other instances, hut as both “ cited ” appears in the public papers there is no harm in letting such facts—particularly at the present juncture —bo known as widely- as possible. So, too, is it more difficult to define where legitimate fraud ends and where illegitimate fraud begins.—l am, etc., F.M. February 4.
