FINE OF £100 AT AUCKLAND

In a reserved judgment, delivered today. Mr. C. R. Orr-Walker, S.M., convicted Francis • Brewer of using buildings in High Street as a common gaming-house, but dismissed a further charge of being the occupier of the premises. The Magistrate said the prosecution, failed to prove that Brewer was: thft real lessee or that a lessee called Bodney was really Brewex-. "I understand the defendant: has > served - gaol," said the Magistrate. ■ referring to the first charge, "but I:don't intend to imprison him this time. I have made up.my mind to impose the maximum penalty unless there is a good-argument to the contrary." v
Counsel' for .the defendant' said'„it was unnecessary for him. to make any further remarks. .
The Magistrate imposed a fine4 of £100 and costs 10s, adding: "I am assuming the defendant -will give up the business." "
