COMMITTED FOR TRIAL

NEGLIGENCE ALLEGED

A sequel to a fatal accident -which occurred in the Ngahauranga Gorge on. 13th April, when Vio Ict Amelix Cook and Norman Webb Cook lost . their lives in a motor collision, was heard in. tho Magistarte's Court this morning before Mr. E. Page, S.M.

Edward Storey, .branch manager of Smith, Wylie, and Company, Ltd., was charged with negligently driving a motor-car, there>y causing the deaths of two persons. Mr. H. 11. Cornish and Mr. N. A. Fodeh appeared for the /jfendant. Sub-Inspector C. W. Lopdcll prosecuted on behalf of the polii r. The first witness called was Dr. W. F, Shirer, who said that on Sunday, 13th, April last, he was motoring in the Ngahauranga Gorge between 2.30 and 3 p.m. Near the top of the gorge he arrived at the scene of the accident, where Mrs. Cook, was lying dead and Mr. Cook was seriously injured with a crushed chest and ■ suffering severely from shock. At witness's direction he was removed to the Hospital.' Mrs. Cook, on examination, was found to have a fractured skull. Mr. Cook died later at the Hospital. He noticed that the car in which Mr. and Mrs. Cook' were travelling was lying in 'a creek some distance below the level of tho road. In his opinion, the injuries received by Mr. and Mrs. Cook could only have- been received when the car fell into the creek. • .
