STRUCK OFF THE ROLLS
SOLICITOR' PUNISHED
An application to strike off the rolls John Munro Gillies, solicitor, of Dunedin came before the Court of Appeal, consisting of lus Honour Mr. Justice Herdman and their Honours Mr. Justice Seed and Mr. Justice Adams, to-day. The application was made on the grounds that Gillies had received £571 12s prior to 10th September, 1926, and had allowed his trust account containing moneys to be diminished by drawings, so s that on and since 10th September, 1926 it contained only 18s 7d.
Mr. Justice Herdman: "It appears to be clear on the evidence that he made use of this money."
Mr. H. F. Yon Hiiast (representing the New Zealand Law Society): "That is so your Honour."
A further ground for the application was that on 2nd June, 1926, Gillies had received from Messrs. Irwin and Irwin £176 18s on behalf of W. J. Benn, that it became his duty on instructions from Benn to tender the money back to Irwin and Irwin, ihat he never did so, but retained the money, and concealed from Benn the fact that it had been retained.
The Court made an order striking Gillies off the rolls.
