A BROKEN WINDOW

Thomas O 'Hara. was charged at the Supremo Court yesterday with attempt' ing to break and enter the premises of the New Zealand Farmers' Distributing Company, on the Ilutt road, on the afternoon of the 27th November, 1926. George Gardiner, a carpenter, working on the premises, said that shortly after 5 o'clock on tho Saturday he heard a crash of glass, and on investigation saw the accused at tho back of the premises, where a small window had been broken. The accused O'Hara was with another man, and they both made off when witness confronted them. Similar evidence was given by James Douglas Hislop, who was working with Gardiner.

Evidence was also given by Detective M'Leiman, who stated that whilo making off, the accused's companion was struck by a train, and was at present in the Hospital. The jury failed to agroo, and a new trial was ordered for Monday. The accused was represented by Mr W. B. Leicester.
