A WORKMAN'S ACCIDENT
CASE BEFORE COURT OF APPEAL.
An appeal against the granting of a new trial in the case of John Alexander Holloway against Charles Pickard Lamb came before the Court of Appeal to-day. On the beuch were the Chief Justice (Sir Robert .Stout), Mr. Justice Hosking, Mr. Justice Herdmau, and Mr. Justice Reed. The order was made by Mr. Justice Salmond, who, in addition, allowed costs to the defendant.
Mr. H. H. Cornish appeared foT the appellent, and Mr. P. H. Putnam for the defendant.
The case arose as a result of an accident to the appellant on 10th October, 1922, while engaged on the erection of a building in Holland street, Wellington. The appellant claimed the sum of £750. as damages. Judgment was given fur the appellant for £300, but Mr. .Putnam, on behalf of the respondent, . mover! for a new trial on the ■noi'tH tb.-.t the verdict was against the n-.>i->iii of the evidence. Mr. Justice 'y.ilr.!on:t-(ifdered anew trial, and" also ordered that the appellant should pay the rosis of the first trial. It waa ajniiifl both these orders that the appeal was made. (Proceeding.)
