AUCKLAND AND DRURY RAILWAY ACT, 1868.

Thi following is a copy of the bill submitted to the Provincial Council by the Government, and which has be«n read • first time : — , Whereas by the Auckland and Itarury Railway Act 1867 of the General Assembly it was enacted that the Superintendent and Provincial Council may by Act authorise the disposition by mortgage sale or lease of the railway or any part thereof upon such terms and subject to such conditions as to the Superintendent and Provincial Council shall seem meet and it is further enacted that the whole of the powers and authorities given to and vested in the Superintendent by the Auckland and Drury Railway Act X 863 of the General Amenably and the Acts incorporated therewith may be given by the Superintendent and Provincial Council to and vested in any P«"«> n or persons who shall undertake the completion of the railway or any part thereof and whereas it is expedient to dispose of the said railway and to vest the powers conferred by the Auckland and Drury Rail* j way Act 1863 in manner hereinafter provided : Be it therefore enacted by the Superintendent of the province of Auckland with the advice and consent of the Provincial Council thereof as follows : 1. The short title of this Aot shall be " The Auckland and Prury Railway Act 1868." 2. It shall be lawful for the Superintendent with th« advice and consent of his Executive Council to mortgage sell or lease the lands conveyed to the Superintendent for the purposes of such Act and also all the plant mud other personal property connected therewith Provided that any such disposition of the property aforesaid shall be made on the condition only that any such mortgagee lessee or purchaser shall be compelled to complete the railway in the manner prescribed by the aforesaid recited Act. 3. The Superintendent with the advice and consent of his Executive Council may make such other conditions as to the completion of any contract made by virtue of this Act for the purpose of effectually working and carrying out the railway between Auckland and Drury or such other termini as may be expedient.
