Magistrate Did Not Know It ’ Was An Offence
"1 myself did not know it was an offence,” said Mr. J. 11. Luxford, S.M.. in the Magistrates’ Court. Wellington, yesterday, when a defendant said he was not'aware that it was an offence to distribute pamphlets. The defendant was Patrick , Jay Shannon, described by the police as manager of the State Theatre, Courtenay Place, Wellington.
Sub-Inspector J. A. Dempsey said that perhaps the offence was trivial. Shannon bad had pamphlets printed; lie had been doing it for some time and did not know it was an offence. The city council raised the objection that when pamphlets were handed out they were not always taken home. Sometimes they were thrown on the street, and became a litter.
The magistrate: A lot would depend on the pamphlets. Some are interesting and attractive. Shannon said lie had never before been questioned about distributing pamphlets. As it was not a well-known by-law, and taking into account the circumstances, he would convict ami discharge Shannon, said the magistrate. It, was the first, case of its kind ho had heard.
