PRISONER DISCHARGED ON MURDER ~ . . COUNT. By.Telecranh—Press Association—Oopyrlirht (Kec. August 3, 9.25 p.m.) Sydney, August 3. The State Attorney-General, Mr. Holnian, has declined to file a Bill against Jones, one of the men committed for trial on a charge of murdering Ryan (sic) at Newcastle. Jones has been discharged, and rearresteil on a charge of stealing tho revolver with which Ryan was shot. AN UNUSUAL CASE. The Press Association has sent no previous advice of the shooting of anyone named'Ryan at.Newcastle, recently. Th?re have, however, been previous messages relating to the allosred shooting of Timothy Jliehacl Dalev, alias M'Guire. by George Smith and Thomtis Jones. ' Possibly this is the cas«! referred to in th« above message. Daley was found in Scott Street, Newcastle, , on the morning of Sunday, July 16, with a revolver bullet in tho head. At the inquest Constable M'Gann deprsed that while on a tram he heard a Shot fired: and, mi jumping off. found the body of deceased lying on the footpath, with tho head propped against die door of R. Hall and Sons' warehouse. There was a bullet wound in the right temple, from which blood was spurting. A revolver, ' with two loadc'l cartridges and oneempty shell in tho chamber,' was beside the body. Tho two men, George Smith and Thomas Jones, were standing a conplo Of yards away.
, Tho prisoner Jones, in his evidence, described tho movements of Smith and himself on the day preceding tho tragedy. Smith and ho walked down Scott Street nnrt met deceased. Deceased was sitting near witness; and Smith Was opposite, about sft. away. Smith was given a couple of ehillings by deceased, and came, back with, some whisky in a flask land some, lemons. ' When the shooting took place witness was standing with his back towards deceased. Hβ heard the report, and. turning round, saw that deceased had been 'shot. The revolver was lying between doceased's left leg and the door of the warehouse. Witness did not know who fired the shot. He had not seen tho revolver before, and did not know where it came from.
