\ EVIDENCE AT HASTINGS. (Br TELEQBAFH. —SPECIAL CORRESPONDENT.) . Hastings, September 4. Another phase of tho case Francis Davis v. Philip J.' Murtagh, involving a claim for the return of moneys paid to defendant at Wellington fpr a freak' show consisting of a freak foal and calf, tent pole, and accessories, came on at the Hastings Magistrate's Court, before Mr. Brabant, S.M., to-day; when the evidence of Edward J. Baldwin was taken on .commission. _ ; Mr. Scannoll, for plaintiff, said he was in tho position of having a typed copy of his witness's evidence, but ho was afraid tho witness would not confirm the statements ho made.' 1 Before going into the box, Baldwin protested that he knew nothing whatever about the case, 'but his Worship directed him to take tho oath and answer quostions. Edward J. Baldwin, journalist, deposed that he knew Alexander Frank Davis, whom he met in Wellington somo time after last Christmas. He fid not remember strolling with, him into defendant's show in Wellington. He did not remember any conversation between defendant, plaintiff, and himself in Wellington at any time. Ho had a conversation with Mr. Scannell this week. He then replied to certain questions. The statements he made then were lies, and he was sorry he had said what ho did. Ho met tho defendant: since in his boardinghouse, and .discussed the case, but not the statements he made to him (Mr. Scannell). Witness was a friend of the plaintiff, which accounted for the false statements mado to Mr. Scannell. His Worship said he thought the ovidenco would not be of much sorvico to Mr. Scannell's case. Mr. Scannell agreed, but stated ho desired to show the position ho had been placed in.
