Letting fees
Sir,—Bronwen Jones is right in saying (October 15) that when a landlord lists a property with an agent it is the landlord rather than the tenant who should be charged any rental fee. Moreover, it is naive for the Housing Corporation to suggest that a tenant who signs a standard form agreement is thereby expressing willingness to pay an agent's fee. Indeed, the suggestion begs the very question posed by the article, which is whether* the Rent Appeal Act renders such a fee illegal. The Housing Corporation.is responsible for administering this Act which prescribes penalties for offences against it. If the Corporation does not take action to enforce the Act, who does? If action is not taken in the courts, what remedy does the tenant have? It only needs the Corporation to act once for the practice to stop.—Yours, etc., JANE CHART, Lecturer in Law. October 16. 1981.
