Trust’s application adjourned
(Neu, Zealand Press Association) AUCKLAND. An application by the Auckland Medical Aid Trust asking the Supreme Court to review the issuing of a search warrant which authorised a police raid on the Remuera abortion clinic was on Friday adjourned until October 10.
The adjournament was sought in the Supreme Court at Auckland by counsel for the trust, Mr B. H. Giles, and consented to by Mr B. L. Bridger, counsel for the other parties. Mr Justice Speight granted the adjournment, but said it should be clearly understood that he did so in accordance with the wish of all parties. Named as respondents in the action were: Nigel Ross Taylor, the Magistrate who authorised the search warrant, William Angus Harold Sharp, the Commissioner of Police, and the AttorneyGeneral (Dr Finlay). In seeking the adjournment, Mr Giles said a Court order had been made that all material placed before the Magistrate in support of the application for the issue of the search warrant, be filed in the Supreme Court by September 25. He said the material was filed on the afternoon of September 25, and the applicants were not able to obtain a copy until the next day.
The applicants had not had time to adequately consider the material and Mr Giles said that in any event, the Solicitor-General "has advised that he will be representing some of the defendants at the hearing and he has indicated that October 10 would be a more suitable date.
