Apprentice Appeal

An appeal by Blenheim Road Motordrome, Ltd., against a decision of the North Canterbury Motor Industry Apprenticeship Committee declining consent to the apprenticeship of K. J. Maher has been allowed by the Court of Arbitration.

Judge A. P. Blair said the appeal was whether the company’s premises and facilities at 63 Blenheim road were satisfactory in terms of clause 4(a) of the apprenticeship order.

The basis of the objection of the committee was that the present premises were essentially of a service station nature and there was a fear that in the future this side of the business would develop to the detriment of the garage side.

Judge Blair said the Court agreed with the committee that in general a service station without adequate garage facilities and a continuity of work available was not an appropriate training ground for apprentices. After hearing the submissions and evidence and having inspected the premises, the Court felt that so long as the garage facilities were at] least maintained on the present footing then the proposed apprentice should receive adequate training in terms of the order. The appeal was allowed subject to the company giving a formal undertaking in writing to the committee that during the term of the apprenticeship contract it would not permit the present garage working space or facilities to Ibe reduced.
