T.A.B. LOSES CASE
Bid To Stop Paper <N Z. Press Assn.—Copyright) MELBOURNE. Mr Justice Gowans refused tn chambers yesterday to stop publication of a racing and tipping newspaper called T.A.B. which is due to come out this week. The Totalisator Agency Board sought the injunction pending a Supreme Court action in which it is suing the publishers. Turf News Pty. Ltd. The board claimed its reputation for impartiality would be damaged by the use of the name T.A.B. as the public would be misled into believing that the board was associated with the newspaper. Mr Justice Gowans said he would dismiss the summons for an injunction on receiving these undertakings from Turf News Pty Ltd.:— The newspaper would sub■titute a horse's head for its proposed insignia of a jockey's cap and crossed whips, which is similar to the insignia of the Totalisator Agency Board, and it would print these words under the title T.A.B. in bold and legible type: “Not a publication of the Totalisator Agency Board.” Mr D. N. Sonenberg, for the company, gave the undertakings.
