Award Of £7201 For Injuries To Man’s Arm

WELLINGTON. June 12. Damages of £7201 againsit the Crown were awarded Edmund Hartley, aged 63, a traverser operator, in the Supreme Court at Wellington today for injuries which necessitated the amputation of the major portion of an arm. Hartley was formerly a traverser operator employed by Straits Air Freight Express at Rongotai. The Railways Department owned the traversers used for the transportation of goods from the rail storage depot at Rongotai to waiting aircraft. Hartley claimed that on
January 18. in the course of his employment, he was struck and crushed against a ramp by one of the traversers which had been set in action by an 11-year-old boy, Graham Flipp. It was alleged Hartley was struck because of the negligence of a Railways Department driver named Walter. Hartley claimed £lO,OOO general damages and £5BO special damages. The Crown denied negligence. The jury found Walter was negligent in a manner causing or contributing to the accident in failing to prevent Flipp from driving or continuing to drive the traverser and in permitting Flipp to remain in the vicinity of the traverser. It assessed damages of £7580, reduced by 5 per cent, for contributory negligence. Mr Justice Hutchison entered judgment for Hartley.
