TWO TRUCKS IN COLLISION

Damages Against Crown (N.Z Press Association) AUCKLAND. Nov. 16. A jury in the Supreme Court at Auckland today awarded damages of £544 2s Id to Apanui Transport, Ltd.. of Te Kaha, against the Attorney-General, representing the Ministry of Works. The case was heard before Mr Justice Woodhouse. The claim arose from an accident on April 22, 1958. when an articulated truck belonging to the plaintiff struck a Ministry of Works truck near a bend on the East Coast road, near Opotiki. Both trucks went over the bank and the tractor unit of the articulator was wrecked. Apanui Transport claimed £5OO general damages, and special damages of £BlO for the tractor unit, £47 Is 9d for the cost of fitting the trailer to a new tractor, £2O for hiring a truck while the articulator was out of action and £9 Is 4d for the hire of a driver for the replacement truck. The jury apportioned negligence as two-thirds on the part of the Ministry of Works and one-third against the plaintiff.
