MAGISTRATE’S COURT

FRIDAY (Before Mr Rex C. Abernethy, S.M.) REMANDED Derek Thomas Hyett, aged 22, a labourer, pleaded not guilty when charged with being under the influence of liquor or drugs when driving a motor-vehicle in Gloucester street on November 15. On the application of Sub-Inspector C. H. Reardon. Hyett was remanded to Monday. Bail was allowed in the sum of £25 and one surety of £25. Ivan Keith Sutton, aged 17. a student and workman, pleaded guilty to a charge of being a rogue and vagabond in that he had insufficient lawful visible means of support, having been previously convicted of being idle and disorderly on November 13. Sub-Inspector Reardon said that at 2 a.m. on November 15 accused had been found roaming the streets by a constable. He had been advised to see the Probation Officer. Yesterday morning he was found again roaming the streets and still had nowhere to sleep. He said he d’d not want work and expected to be sent to Borstal. He had 3d in his possession when taken to the police station. He was physically fit out there was a doubt about his mental stability. Mr J. W. Jordan, a probation officer, said he had had a telephone call from Sutton’s father, who said he could do nothing with the boy. Accused had been offered jobs, but did not want work.

The Magistrate adjourned the charge until later in the day. when Sutton was remanded in custody for a week for medical observation and sentence. TRAFFIC BREACHES

Marjorie Alice Horridge (Mr F. P. Hill) was fined £2 on a charge of failing to give way on October 4. She pleaded not guilty. Traffic Officer C. Wilson said that about 10.30 p.m. on October 4 he was a passenger in a Christchurch City Council patrol car in Moorhouse avenue. The car turned round to travel east to check the speed of a car which was believed to be doing more than 30 miles an hour. The patrol car was travelling at between 25 and 30 miles an hour when approaching the Selwyn street intersection. The driver braked and then swung to the left in an attempt to avoid an old model car which was travelling south in Selwyn street. The front of the patrol car struck the rear wheel of the vehicle, which spun round to face west in Moorhouse avenue. As it was turning the woman driver fell out on to the roadway. Visibility was poor at the time. It was raining and the intersection was poorly lit. Mr Hill said that because of concussion and shock Mrs Horridge remembered nothing of the accident. A passenger in her car would give evidence that she approached the corner at 10 to 15 miles an hour, and that she had virtually reached the middle of the road when the accident took place. It appeared that the traffic officers’ attention was focused on the car they were following, and they crossed the intersection at a speed, which in the circumstances, appeared to be excessive.

James Edward Herriott £2, Michael Rodney Christopher McDowell £4. Stanley Thomas Newton £4, Cushla Mary Talbot £4, Wilfred Norman Fisch £4, Derek Richard Charles Taylor £4.
