At the Supreme Court, John McGovern pleaded guilty to a charge of having committed a breach of the Military Service Act by making a false declaration. x McGovern was married on August 11th, 1915, and by inadvertence the clergyman who officiated put the date as April 11th, 1915. This apparently placed McGovern in the Second Division, although he was really in the first. McGovern handed the certificate to the IX>fenco authorities, and later on, in learning of the error offered to enlist, but the offer was not accepted. He was anxious to enlist, and had sold property and suffered financial loss The Chief Justice referred to the Defence Department's action as a piece of red tape, and on tho condition that McGovern would again enlist no sentence was imposed.
