At the J'olieo Court to-day, John T Lees, -secretary of the Licensed \ i<•tuallcrs' Carnival Committee, was charged ivith a broach of the Gaining; and Lotteries. Act in connexion with the £1000 art union. depending on tiio rev suit, ol the Auckland Cup. A formal plea of "guilty'' vras' entered. It was explained that the whole proceeds of the .salf> of the tickets, wore handed to tlie Carnival Committee, but differed Irom the other lotteries, which had ihe express sanction of the Minister, while the sale of tickets continued alter defendant was warned by the police. Mr F razor. S.M.. said the moral aspect of the lottery was no different from others in (oimexioti with the Carnival, except in. the particular that the promoters had not obtained a permit. It was the element of horse-ra'-in<i about it which possibly liad affected the Minister's decision, bnt liorse-raeinj; was merely incidental and did '")t increase the element of chance. Apparently the Carnival Committee had relied 011 the Minister's assurance made in conversation with a member of the committee. but be had mnhinj; before him (.Mr Frazer) to -how that the Minister fully understood the full circumstances. The committee was culpable in that it had not applied for a permit. Inn the breach Has a technical one. He .recorded a conviction and ordered defendant to pay costs. 495.
