[Before Hia Honor Mr Justice Johnston.] : WIIBOIT AHB AKOTHBB V ERIGHTT.TNG. i Mr Austin appeared for the plaintiffs, •and Mr Harper, with him Mr. McConnel, for the defendant. From the statement of claim it appeared that Hyam Davis leased to plaintiffs the Union buildings in Cashel street from Jane Ist, 1875, for fourteen yean, at £160 per annum. On November 21st, 1879, the plaintiffs transferred to one C. B. Taylor, who, by memorandum on 80th March, 1832, transferred the lease to the defendant, John Brightling, who registered the transfer on April 26th, 1882. Defendant having failed to pay the rent, plaintiff had been compelled to do so. Plaintiffs claimed that defends nb ought to indemnify them the sum cf JB2BO damages, or i such, amount as the Court might think fit. The defence denied most of the allegations in the statement of claim, and further alleged that defendant on February sth, 1885, transferred the lease to one Alexander Stewart Gilehrist. The question for the Court to decide was really what the effect of the transfer was from Brightling to Gflchriat. Mr Au3tin having opened the case, called George King and James M. Batham, who gave evidence. Mr Harper then submitted that the plaintiffs should-be nonsuited. After hearing argument at some length, hie Honor reserved judgment on the nonsuit point. The Court then adjourned until Monday next, at 11 a.m.
