MUST PAY AGAIN.
RELIEF WORK CONTRACTOR.
MEN'S WAGES NOT RECEIVED.

WHAKATANE, this day.
Ten Maori relief workers 'yesterday sued Gilbert Kirkbride, of Waimann, for £111 9A the balance owing on a contract entered into by Kirkbride with the Waiarilcl Native Land Board in 1931, under the unemployment 4B scheme.
Evidence was given that the money had been paid by Kirkbride to Gordon Park, then secretary of the Wliakatane unemployment committee. Park was recently convicted of embezzlement. The money had never been received by plaintiffs.
William Sullivan, chairman of the unemployment committee, gave evidence that Park had no authority to receive money on behalf of the committee. Kirkbride paid the money and received a receipt, under the impression that Park was the official receiver for the committee.
The magistrate held that defendant could have paid the men himself. If he had not endeavoured to throw the onus of paying on to someone else then the unfortunate deficiency would not have occurred. Under the circumstances defendant would have to pay again.
