NEGLIGENCE ALLEGED.

YOUNG MOTOR DRI.VER,

GREAT NORTH ROAD FATALITY.

The sequel to a fatal accident in Great North Road on May 2G was heard at the Supreme Court to-day, when a youn" man named John George Collins was charged with negligently driving a motor car so as to cause the death of a boy named Edward Antonovich. Accused was represented by counsel. Mr. Justice Herdman presided.

The Crown Prosecutor referred to the prevalence of accidents on the highway, and emphasised the duty of all drivers to exercise reasonable care. Because deaths were so frequently happening as a result of motor accidents, he said, the jury must not conclude that every person charged in such a case was necessarily guilty. Every case must be judged on the evidence presented. In this case it was alleged that accused was directly responsible for what occurred. Collins was driving from Auckland alon S the Great North Road, and the accident occurred near th» junction of Wilmer Road, near Point Chevalier. Two boys were cycling towards the city, and one of them was knocked down. It was alleged that accused cut the corner, and "uve°no warning of his intention. The second of the two boys swerved aside in an attempt to avoid the collision, but was knocked down, and received severe injuries to the head. He died in hospital next day. * The hearing is proceeding.
