UNPROVOKED ASSAULT.
SEAMAN FINED £2.
NO TIME TO PAY FINE
Mitchell Leahy (4o), a burly seaman, who appeared at the Police Court this morning, pleaded not guilty to a charge of assaulting John Patrick Donovan.
Donovan, a medium -built, middle-aged man, said ho knew accused. Some time ago they were shipmates together. Yesterday he was standing on the footpath leaning against his fence when Leahy challenged him to fight. "I told him I did not want to fight him, but with that he hauled off and struck me twice on the face," said witness. "I was smoking my pipe at the time, and had one hand in my pocket."
Donovan's evidence was fully corroborated by the arresting constable, who witnessed the assault.
All that accused had to say was that Donovan had wanted a fight some time ago-
Leahy, who had a list of previous convictions, the last one being for assault, was fined £2, or 14 days' imprisonment. Time to pay the fine was refused.
