SEQUEL TO LEFT GOODS SALE

CLAIM AGAINST HARBOUR BOARD. PLAINTIFF NONSUITED. The left goods sold periodically by the Auckland Harbour Board are disposed of subject to the Customs dues being paid by the purchaser. This fact was revealed in the Magistrate's Court this morning, before Mr. E. C. Cutten, S.M., when F. J. Evans claimed £390 from the board for goods sold by it without his knowledge. The goods, consisting of carburetors, were landed in Auckland from the s.s. Kurow on November 25, 1926, and were sold at public auction by the board on May 26, 1927.

The defence was that no arrangement had been made in regard to the property by plaintiff. Mr. Butler, for plaintiff, described the system of collecting Customs dues on the goods as a comedy of errors, and contended that the board should have taken proper precautions before disposing of the carburetors. Observing that plaintiff had never taken the trouble to obtain possession of the goods, the magistrate nonsuited him, and entered judgment for the defendant board.
