i . MOTOR BUS OWNER FINED. RESERVED JUDGMENT DELIVERED. ■Reserved judgment in the case in which the Auckland City Council (Mr. McKay) sued J. L. dunning (Mr. Field) for failing to start his omnibus from a stand in accordance with the time-table nproved l>y the inspector of the City Council, was delivered by MY. W. 1!. McKean iji the Magistrate's Court " yesterday afternoon. After reviewing the evidence, the magistrate said that there was no inequality in the incidence of the by-law. It was not unreasonable to regulate the movements of omnibuses without regulating at the same time the running of tram cars. The contention that a local autliorilv was bound at one ti : 11 <■ to regulate all the different modes of transport waa not sound. The defendant would be convicted and fined £2. .if nn appeal wn« desired the amount of the fine would be £5 1/, and security £10 10/.
