Fred Fish backer, a cinema director, and a friend of Arbuckle, who was present at the fatal party, testified that he carried Miss Rappe and put her in a cold bath. He "declared that he held her so that the blood would go to her head. He declared that Arbuckle was not intoxicated, and that he did not hear Miss Rappe utter any cry.

The defence contended that the manner in which Miss Rappe was carried produced the bruises on her body, and intimated that medical experts would testify that the rupture of an internal organ was due to muscular contraction as the result of immersion in a cold bath. (A. and N.Z. Cable.)
