(Continued from page 5.) THE ATHEXIC STEWARDS. The hearing of the charge against the three ship's stewards. Alfred Jenkins, Frank Fox, and Frank Stephen Blackwood, of having Im the --il'.th ult. assaulted an old man named Adolphus Kyngdon so as to cause him actual bodily harm, was begun after the luncheon adjournment, the Hon. J. A. Tole, K.C. conducting for the prosecution, and Mr. J. K. Lundon defending.

Evidence for I ho Crown was given similm to that produced at the Lower Court, the circumstances, as stated, being that Mr. Kyngdon, an old gentleman 73 years of age. was knocked into the gutter from the edge of the footpath in Quaystreet on the afternoon in question by the young men. who were walking along arm in arm, and in a semi-drunken condition. The sworn statement of Kyngdon, who is still in the hospital, was read. He stated that he noticed the trio coining along in what appeared to be a recklessly boisterous manner, and for which he went to the edge of the krrlnng in order to avoid a collision. Jiut in passing, however, they appeared to lurch towards him. and he felt a heavy blow on the shoulder, awakening a little later to the consciousness of extreme pain, and of lying in the gutter with several people about him. In falling he struck his head ngainst the wheel of a vphicle standing near the kerb.

After the collision, it was stated, the three men proceeded on their way. while Kyngdon was taken to the hospital, where it was found he had suffered a fracture to the inside bone of the hip.

Several witnesses gave evidence as to seeing the occurrence, and the previous see-saw progress of the three along the footpath.
