■At--the Supreme Court civil sittings to-day the ease J. .T. Craig- and Taupin Ccal ■; Mines (Limited) v. Assets Realisation Board and Mrs <>• Wallace" Vas commenced. The claim is to execute memo, of transfer of a' certain property. Mr Theo. Cooper and Mr C. J. Tunics, instructed by Messrs .Taekson and .Russell, appeared fpr the plaintiff company, and Mr Thbs. Cotter, instructed by Mr M. ifeGregor, for Mrs Wallace. The ease is .a somewhat complicated one. The plaintiffs set forth in their statement of claim that some time ago the Taupiri.Cpal Mines, Limited, purchased from the Assets Realisation Board" for the sum of £4000 the Woikafo coal mine, situated on lot 7, Parish ofPepepe, on the -western bank of the Waikato Biver, together with the machinery? plant, etc., as a going concern The Assets Board received the irionev, but, it is stated, conveyed lot G on"which there is no mine, to the company, instead of lot 7, the latter property being- sold to Mrs Wallace, whose husband was formerly manager oJ the Waikato mine. The company now claim the mine should Ue conveyed to them according to the original agreement, and that the memo of transfer should be executed. A number of witnesses were called, and the case was proceeding all day.
