CLAIM FOR EXPENSES.

At the Magistrate's Court this afternoon a case Wm. Thos. Goodwin v. Thos. Stewart was heard, before Mr Brabant, S.M. Plaintiff claimed £5 expense for giving evidence at Hamilton on behalf of defendant in a protest lodged by Stewart against a horse called "Hunua," winner of a race at the Hamilton Trotting Meeting on May 24, 1895. Mr F. H. Williamson appeared for plaintiff, and Mr C. Z. Clayton (Hesketh and '.Richmond) for defendant. Goodwin in evidence stated tihat Stewart had agreed to pay him £5 and expenses if he would go to Hamilton and give evidence in the inquiry against Hunua, to prove that Hunu,a was "rung in." Witness said that he went to Hamilton and gave the evidence, with the result that Hunua was disqualified and the stakes were paid to defendant's Effie. E. Sandall deposed that he was present when Goodwin made the arrangement to pay Stewart £5 and expenses. . •,., : ~ Thos. Stewart, the defendant, said that four years ago he had a. mare named Effie running at Hamilton. The race was won by Hunua, and he lodged a protest that Hunua was "rung in." He heard from Sandall that Goodwin knew something about Hunua. One Sunday morning at Eden Terrace, Sandall, Goodwin, and witness had a talk about the matter. He did not authorise Sandall to make any offer to Goodwin. The final arrangement was that Goodwin was to go to Hamilton and give evidence, and witness would pay his expenses and "ive bin. a reasonable sum for his trouble. After the inquiry was over witness gave Goodwin a.book-

maker's ticket for £2, which Good! win agreed to accept in full settlement of Ids expenses.

Judgment was given for plaintiff for £5, with costs £ 2 4/6.
