ASSESSMENT COURT.

CITY OF AUCKLAND

A sitting of the Assessment Court for the City of Auckland was called for this morning at.the S.M. Court. -Mr H. W. Brabant, S.M., sat on the bench. Mr Theo. Cooper appeared for the CityCouncil, and Mr E. Hiekling-, cityvaluer, was present. It appears that objections to the valuation lists had been sent- in to Mr Burgess, clerk of the Court, by Mrs W. Gulliver on Saturday, who alleged that the notices issued by the local authority did not comply with sections 20 and ?A of the Eating. Act, and that the witting- was not in accordance with the requirements of section 23 of the Act, and that in consequence the whole of the valuation lists for the six wards are ultra vires. These objections were, not read. Mr Cooper asked for an adjournment for a fortnight in order that the tim-2 required under sections 21 and Si! of the Rating Act might expire. Mr P.raban.t said he understood there was an Order in Council extending the time, of fixing1 the sitting1 of the Court for to-day. Mr Cooper said the Order in Council did not extend the time on which the valuation could be made. It only contained authority for completing1 the preparation of the valuation list till 17th May. The sitting1 of the Court was then adjourned until Monday, 3rd July, at 10a.ni. Mr Tole asked that the date of titting of the different wards be announced, so .'is to save the time of persons interested and solicitors.

The Magistrate stud Mr Burg-ess would consult the City Council officials and the day on which objections would be heard in Ihe different wards would be advertised.

Sections 21 and 23 of the Rating Act road as under: —

(21) Every objector shall not less than ten days before the sitting of the Court send to the local authority a copy of every such objection made by him.

(23) If any person objects to any entry in or omission from the valuation list, or to any value therein, affecting- the interests of any other person than the objector the clerk of the local authority shall send to the person or persons so affected a. copy of such objection. Such objection shall be delivered to the person affected, or left at his last known place of abode or business, not les than five clear days before the sitting of the Assessment. Court.
