MRS YANDLE'S XMAS TREE.
Jane Yandle was charged at the Police Court this morning, before Mr H. W. Bishop, R.M., with a breach of the Gamingand Lotteries Act "by establishing a lottery at tiie Masonic Hall, Newton.
Mr O'Meagher appeared for the defence, and pleaded not guilty.
Inspector Brohatn stated the facts of fcho case.
Sergeant Bernard deposed that ho visited Mrs Yandle's Christmas tree in the Masonic Hall last week, and advised her to see the Inspector before commencing the sale, a3 she explained that she was running ib on the lottery principle. Eβ boughb a ticket himself from Mrs: Yandle, with a number on it, and was told that ho would bo able to get a prize with a corresponding number on it. On the following day she handed him a prize which she said his ticket had won. Everything he saw in the place was value for the money; some of the articles wore more than, value for the shilling charged for the ticket.
To Mr O'Meagher : Witness declined to say whether he had been urged to proceed against Mrs Yandle by tradespeople in theneighbourhood of the Masonic Hall. Mostiof the articles offered' were, he believed, made by Mrs Yandle and her daughters.
George Cann gave similar evidence. Ha sold toys and fsney goods in N"ewfcon.
Mr O'Meag-her held thab though the lottery had without doubt been established, stiil no offence had been committed, for she was innocent of any intention to do wrong,, and her Christmas tree was not gofc up with a view to swindle the public. She discontinued the lottery as soon as she knew she w<l3 doing wrong.
Mr Bishop said the duty of the police was* to bring general notice to these cases and similar ones, and he was convinced thafathe general practice of gambling now pervading the community, was productive , of serious injury to people and the State. He thought, however, that in a case like this a nominal penalty would suffice, and ho accordingly fined the defendant 20s and costs.
