SUCCESSFUL CLAIM.
THIRD PARTY INSURANCE. MOTORIST'S BREACH OF - CONTRACT. (Per Press Association). HAMILTON, Dec. 3. . A ease, of interest to insurance companies and motorists was heard in the Supremo- Court at Hamilton to-day, when the South British Insurance Company claimed £382 from Torrence James Patrick Cleary, agent, of Hamilton, for an alleged breach of an insurance contract. «.•'•• The case was taken under Section 11 of the Motor Vehicles Insurance (Third Party's Risks) Act, 1925, which insists that owners of cars involved m accidents must notify the insurance company forthwith. The plaintiffs' evidence was that Cleary failed to notify the office, whose first intimation of the accident was three months afterwards. . , . The defendant denied the plaintiffs' evidence, maintaining that he complied with the statutory requirements. : . ~ Remarking that he placed no reliance on the evidence of the defendant and that defendant was clearly responsible for a breach, his Honor found i for the plaintiffs for the full amount claimed.
