APPEAL COURT.

APPLICATION FOR NEW TRIAL. (Per Press Association) WELLINGTON, March 16. The "Court of Appeal heard argument to-day on an application by Walter Anderson Clifton, of Wellington, for an order granting a new trial on both counts of an indictment charging him with indecent assault 'on a young female, which was tried in the Supreme Court at Wellington on October 31 and November 1, when he was found guilty. The substantial grounds of the application are that the verdict of the jury was against the weight of evidence, and that it is in the interests of justice that a new trial be granted. The indictment was first heard in Wellington in August, when the jury disagreed. At the.second trial the jury returned a verdict of guilty, with a recommendation for leniency. The members of the Bench are the Chief Justice (the Rt. Hon. Si? Michael Mvers), Mr Justice Peed, Mr Justice Smith. The Court adjourned until tomorrow, when the case will be continued.
