COMPENSATION CASE
JURY AWARDS DAMAGES. LAW/POINTS FOR APPEAL COURT (Per Press Association.) BLENHEIM, (December 8. In the Supreme Court, before Mr Justice Blair, there was commenced a civil action which will have important legal aspects before it is finally disposed of. By arrangement, these .will be dealt with bv a Wellington jury. The Cburt has only to decide two points —whether an action which was the basis of claim occurred through a bicycle slipping on the rails of a private siding; and what measure of damages plaintiff had sustained. All other aspects were being left to argument later.
Plaintiff was Andrew Wilson, of Blenheim; and defendants the New Zealand Lean and Mercantile Agency Co. The statement of claim set out that on August 28, 1931, plaintiff was totally disabled as a result of an accident when a bicycle which he was riding was upset through contact with one of the rails of a railway siding leading to the company's stores Plaintiff claimed snecial damages, 63 nvieeks' wages at £2 los per week-(£173 ss), hospital and medical expenses £lll 3s, and general damages £ISOO. The total claim was thus £1784 Bs. /
The jury returned a verdict for £784 3s, and the case was adjourned sine die for legal argument in Wellington.
