The Appeal Court to-day heard act apneal from the decision of"Mr Justice Adams on an originating summons fo'r an order interpreting the will and codicil of John Talbot Wright, late of Christehurch, retired farmer, deceased, and in particular determining whether £IOOO bequeathed by a codicil" to- the testator's daughter, Elizabeth Wright, is payable o\it of the proceeds of/the sale of the Dunsandel farm, or out of testator's residuary real and personal estate. After hearing counsel Mr Justice Adams held that he saw nothing in the will and codicil to displace the general rule that legacies are payable in the first' place out of residue. There were nine appellants, for whom Mr Myers, K.C., and Mr Cooke apoeared, and six respondents, for whom Mr Hutchison and Mr Gresson appealed. Tiie Court reserved judgment.
