A MOTOR COLLISION
SEQUEL IN THE COURT. COUNSEL TO FIX DAMAGES. The case .in which D. G. Smith, of! Ashburton, claimed the sum of £147, 10s 3d alternatively from William Lundy, David Darken, and James Tait, for damages to Ins car, caused by a cola-] sion on the Fail-field Road, on the night of August 17 last, was continued •in. the Magistrate's Court yesterday afternoon, after the "Guardian" went °James' Tait, the third defendant, stated that the car was lent to Larmnl by Lundy, witness accompanying Lun-, dy to Fail-field. He corroborated the j evidence given by Lundy and Larkin. To Mr Twyneham: Witness was not, prepared to swear certain things to save Larkin. He was* not on oath when the constable took his statement, and he admitted telling an untruth to the constable. „ „ iIL . Addressing the Court, Mr Cuthbert said Tait bad admitted throwing dust in the eyes of the Police, but that was because he wanted to save Larkin from being prosecuted for driving a car while he was not licensed. Mr' Twyneham submitted tbat the ear was in charge of Tait, who had allowed Larkin to driven o« the journey home. The Magistrate said there was no case against Lundy, because he lent his- car to Tait and- Larkin for their business. He could only draw the inference that the oar was lent as much to Tait as it was That being so, both men were-itt ehusge,, both having driven the can. Lundy was granted costs'.. . ' . , The question of the' amount of damages was left to counsel', who are to deliberate and submit; their findings, to •the Magistrate.
