SUPREME COURT.
Per Prejss Association. AUCKLAND, February 28. At the Supreme Court, John Alexander Mclntyre was tried for the third time on a charge of having, on November 1, 1910, together with one Joseph Ehrman, stolen a case of cigarette tobacco from the Customs examination shed on Queen Street wharf. This was one of the offences in regard to which there was quite a series of prosecutions. Melntyre was tried twice on the present charge, and on each occasion the jury failed to agree. The jury to-day deliberated for two hours and a half, and returned with a verdict of not guilty. . Accused was discharged. A chauffeur named Rhodes Battye was found guilty of the manslaughter of one John McGonnell, with a strong recommendation to mercy. Accused was sentenced to three months' imprisonment without hard labour.
