Memorandum for Resident Magistrates.
Paragraph 2 of Circular No. 7 of the 12th April last is cancelled from the date hereof, and the following paragraph substituted in lieu thereof :
2. Vouchers for bailiffs’ mileages for sums not exceeding 10s. will be sent to this office, in duplicate, in the same manner as before the issue of the Treasury notice of the 12tli March. After having been checked they will be forwarded by this office to the respective post offices for payment. To prevent multiplication of vouchers, the instruction contained in Circular No. 19 of the Ist October, 1887, as to rendering claims for mileages once a month must be strictly adhered to.
I take this opportunity of pointing out that in criminal cases, where processes are served by constables, such constables are entitled only to a refund of the actual and necessary expenses incurred by them, as laid down in the Police
Regulations. The mileage should be converted into stamps and affixed to the proper documents, and claims for expenses sent to this office. This direction is issued because it is found that in some districts a practice prevails of collecting the mileage and paying it over to the constable serving the process. By order. C. J. A. Haselden, Under-Secretary. Department of Justice, Wellington, 23rd May, 1889.
