Appeals Nos. 25 and lj-S.—Bj Hohepa Poia and others, in regard to the same two blocks respectively. These two appeals were combined together with the main Ngati Manawa appeal for Te Whaiti Block, and heard together with it as one general case. We have weighed and considered all the evidence given in the matter of these appeals, and we do not find any strong evidence of such a character as would in our opinion justify any variation of the original award in regard to Maraetahia Block and its boundaries. In regard to the list of names submitted by Whata Henare for inclusion in Maraetahia and Otairi Blocks, there is no evidence sufficient to establish occupation. In our opinion her rights to the land have become cold, and we consider she has been fortunate in obtaining inclusion in these two blocks for the interests she holds under the award of the last Commission. We therefore recommend that the two lists of names now submitted by her for inclusion therein be disallowed, and her Appeals Nos. 23 and 141 dismissed. In regard to the southern boundaries of the Otairi Block: After carefully considering all aspects of the position, we recommend that these boundaries be amended as shown on Plan No 6848 commencing at the peg at the south-east corner of Maraetahia Block at the place named "Taumata," or " Ngamokaikai-a-te-Ao," on plan, thence running south-easterly by the straight line marked " Tuhoe Boundary" on plan till it reaches the north-east boundary of Te Whaiti Block at junction of Opaheru and Okahu Streams; that portion of the Otairi Block lying to the west of this line to be added to and form part of the Te Whaiti Block. We recommend that all the appeals in regard to Maraetahia and Otairi Blocks be dismissed —i.e., Nos. 23, 24, 25, 141, 142, and 143. The seven persons whose names are hereunder set out are the persons who have been selected from amongst their number by the owners of the land and proposed by them as the members for the Hapu Committee for the Maraetahia Block, and agreed to by all the owners present before this Commission sitting at Whakatane on the Bth day of March, 1907 :— 1. Tihema te Hau. 5. Tureiti Mehaka. 2. Peraniko Kapeta. 6- Tane Hauraki. 3. Manihera Pahiri. 7. Harehare Aterea. 4. Pihopa Tamehana. The six persons whose names are hereunder set out are the persons who have been selected from amongst their number by the owners of the land and proposed by them as the members for the Hapu Committee for the Otairi Block, and agreed to by all the owners present before this Commission sitting at Whakatane on the Bth day of March, 1907 : — 1. Tihema te Hau. *• Peraniko Kapeta. 2. Raka Mehaka. 5. Haare Haare. 3. Hahona Heemi. 6 - Manuka Puritia. Gilbert Mair. D. F. G. Barclay. Paratenb Ngata. Maungapohatu Block. Appeal No. 27. By Mata Tako. This appeal was agreed to by the owners of the land, and the following arrangement was made by consent, i.e. : — (1.) Eighteen shares to be given to Mata Tako in addition to the two shares standing opposite her name (No. 386) in the order, thus increasing her total interest to twenty shares. (2.) Her children and grandchildren—eight persons in all—to be added to the list of owners, with a total interest of forty shares divided amongst them—i.e., five shares each. We recommend that this arrangement be given effect to. Appeal No. 29. —By Te Rahui Hoera, for inclusion of the name Hariata te Kahui (f., 7) tor an interest of ten shares. , . Appeal No. 30. By Matiu te Kurapa and others, for inclusion of the names of Matiu te Kurapa, m., ten shares; Te Mauniko Matiu, f., five shares; Hera Mika, f., four shares. _ Appeal No. 28. —By Hori Pikitia Teihana, claiming the inclusion of the name of Hori Pikitia Teihana (f.) with an interest of twenty shares. Appeal No. 31.— 8y Waaka Paraone te Ranui and others. This appeal was withdrawn by Akuhata te Kaha on behalf of the appellant on the 28th January, 1907. No objection was made before this Commission in regard to any of the above appeals, and we recommend that the proposals in each case as above set out be given effect to. Appeals Nos. 26, 32, 33, SJ,, and 35.— These five appeals are held over for the present, and will all be considered together by us when the case advanced thereunder by Wi Pere and his hapus of the Ngati Kahungunu Tribe is subsequently dealt with by this Commission.
