1901. NEW ZEALAND.

"NATIVE LAND COURT ACT, 1894" (ORDERS MADE UNDER THE), IN RESPECT OF KAIWAITAU AND WAIKOUAITI.

Presented to both Hotises of the General Assembly in pursuance of Subsection (10) of Section 14 of " The Native Land Court Act, 1894."

IN RESPECT OF THE LAND KNOWN AS KAIWAITAU. In the Native Land Court, New Zealand. At a sitting of the Court held at Wairoa, on the 20th day of September, 1899, before William James Butler, Esquire, Judge, and Wi Neera te Kanae, Assessor. In the matter of the Kaiwaitau Block, heretofore held under Crown grant, dated the 13th day of July, 1872. Wheeeas by an Order in Council dated the 18th day of January, 1899, His Excellency the Governor has authorised the said Court to exercise in respect of the said land the jurisdiction conferred under subsection (10) of section 14 of " The Native Land Court Act, 1894"—that is to say, to determine whether or not the said land or any part thereof was, on the investigation of the title thereto, intended by the Native Land Court, or by the nominal owners of such land, to be held by such nominal owners in trust for Natives not named in the title, and to determine who are the Natives, if any, entitled beneficially to such land, and to order the inclusion of such Natives in the title either together with or in lieu of the nominal owners, or any of them, and generally to exercise the jurisdiction conferred by the said subsection. Now, therefore, upon inquiry made into the nature of the title to the said land, and into the existence of any intended trust as aforesaid, it appearing to the Court that such a trust exists, it is hereby declared that the persons named in the schedule attached hereto, and therein numbered from 1 to 82, both inclusive, are the persons beneficially entitled under the said trust as tenants in common. And it is hereby ordered that the Crown grant dated the 13th day of July, 1872, and the orders on partition made by the Native Land Court on the 14th day of September, 1894, be cancelled, and that a Land Transfer certificate do issue in favour of the persons as aforesaid. IN RESPECT OP THE SECTIONS KNOWN AS NOS. 101 AND 102, WAIKOUAITI NATIVE RESERVE. In the Native Land Court of New Zealand, Wellington District. At a sitting of the Native Land Court, held at Waikouaiti on the sth day of March, 1901, before Alexander Mackay, Esquire, a Judge of the said Court, and Te Whatahoro, Assessor. In the matter of the parcels of land known as Sections Nos. 101 and 102, situate and forming part of the Waikouaiti Native Reserve, in the Provincial Land District of Otago, and in the matter of the Order in Council dated the 15th day of August, 1898, declaring that it shall be within the jurisdiction of the Native Land Court to determine certain matters referred to it thereunder, and on application to have the aforesaid matters dealt with in manner provided. Upon inquiry made as to the existence of any intended trust affecting the title to the aforesaid sections, and. it appearing that such a trust exists, and that there has been no alienation, it is declared that the persons who are named in the schedule attached hereto, and therein numbered respectively from 1 to 238, both inclusive, are the persons beneficially entitled under the said trust to a portion of the said sections, containing in the aggregate 29 acres 1 rood and 6 perches, it is hereby ordered that the existing instruments of title for the aforesaid sections be amended in manner following—that is to say, that the persons enumerated in the schedule attached found to be beneficially entitled be included therein for an interest in the aforesaid area not exceeding 19 acres 1 rood and 6 perches.
