Copy of Circular sent to Education Boards. Sir, — Education Department, Wellington, 21st Eebruary, 1878. I have the honor, by direction of the Minister of Education, to forward a copy of " The Public Libraries Subsidies Act, 1877," and to request the attention of your Board to the second section thereof. The sum voted for the purpose specified in the Act is £5,000. The proportion, according to population, which would fall to your provincial district is £ ; and Government are prepared to intrust this sum to your Board for distribution within the Provincial District of , on the following conditions: — 1. That the requirements of the second section of the Act shall be strictly complied with; and 2. That, if the limits of your education district are altered by " The Education Act, 1877," an equitable distribution of the money will be made by your Board, nevertheless, amongst all the public libraries within the said provincial district the managers of which shall comply with the provisions of the Libraries Subsidies Act. You will therefore be good enough to cause a voucher to be forwarded for the amount abovementioned should your Board undertake its distribution in accordance with the conditions herein specified. In connection with this subject I may suggest the advisability of your Board iucluding in its annual report information relative to public or school libraries within your district. Sib, — Education Office, Dunedin, 7th August, 1878. In reply to your circular of the Ist instant, I have to state that the distribution of the vote for public libraries has not yet taken place. "When the Education Board agreed to take charge of the amount voted by the Government, a resolution was passed to the effect that the system of subsidizing public libraries which has been in operation in Otago for so many years should still bo continued. The system referred to is as follows : —Library Committees are invited by advertisement to forward to tho Education Office a list of the books they think suitable, and which they are desirous of obtaining for the use of their libraries. Upon receipt of these lists, an order is made out and forwarded to tho Board's agents in Britain. The order is intrusted to a firm of booksellers in Edinburgh, who supply the books at publishers' prices. On receipt of the invoices from Britain, catalogues are printed and sent out to every Library Committee. Committees are allowed to select books to double the value of the sum deposited by them, the Board supplementing their contributions at the rate of pound for pound. The selection of books by Committees is not restricted to the supply procured by the Board. Committees may purchase books from any of the booksellers, the Board supplementing the amount paid at the rate of pound for pound. The bookseller's receipts are taken as evidence of the amount paid. No profit is charged by the Board on any of the books, and they are supplied to the Committees at cost price. The books are all uniformly and strongly bound in half calf. As the books recently ordered from Britain have not yet arrived, I am unable at present to give a detailed statement of the distribution of the sum of £1,444 6s. granted by the G-overnment for public libraries. Of the borough libraries subsidized out of the recent grant, all have complied with section 7 of Act except the Auckland Mechanics' Institute— £175 granted at the special request of the Hon. Sic,— Board of Education, Auckland, 23rd July, 1878. I am requested by the Board to address you in reference to the apportionment of the grant allotted to this district under " The Public Libraries Subsidies Act, 1877," and entrusted to the Board for distribution in terms of your circular, No. 3, dated 21st February last. Acting upon the instructions conveyed in that circular, the late Board published an advertisement inviting applications from the public libraries within the Auckland Provincial District, and specifying the twelve months ending 31st December, 1877, as the period in respect of which the voluntary subscriptions of each library were to be reckoned in the distribution of the grant. After receiving and considering the applications sent in up to the 31st May, the Board fixed upon pound for pound as the basis of distribution, and grants were accordingly allotted to the several libraries entitled to participate. The applications received from borough libraries were found to represent the sum of £473. These libraries the Board considered to be equally entitled with others to participate in the distribution of the grant, subject, of course, to their compliance with the provisions of section 7of the Act. In the case of the Auckland Mechanics' Institute a representation was made to the Board by the Hon. Mr. Sheehan that that library had been promised a grant under the Act, and at his request the Board included it in the distribution. I forward herewith a list showing the amounts allotted in each case, from which it will be seen that nearly one-half of the grant has been absorbed by borough libraries. There yet remains a balance of £4 7s. unallotted, against which there are claims to the amount of £75 ; and I am desired to request that, in consideration of the circumstances herein set forth, the Government will place a further sum of £70 13s. at the Board's disposal, so that it may be enabled to treat upon an equal basis all applications for grants in respect of subscriptions received during the year 1877. Sic, — Education Department, "Wellington, sth August, 1878. In reply to your letter No. 2,173, of 23rd ultimo, I am directed to inform you that the whole of the vote of £5,000 has been distributed amongst the Education Boards in accordance with the Public Libraries Subsidies Act of last session, and that the Government have no other funds available for making the additional payment asked by your Board. Westland. Sic,— Education Office, Hokitika, 30th August, 1878. I have the honor to acknowledge the receipt of your telegram of 24th iustant, asking for information concerning the distribution by this Board amongst libraries in boroughs of the moneys granted under section 2 of " The Public Libraries Subsidies Act, 1877." The first step taken by the Board was to forward to each society a copy of the Act and to request the Secretary in each case to furnish a statement of the receipts for the year 1877. These statements were forwarded to the Board, and, being considered satisfactory, the Board distributed the grant for this district strictly in accordance with the provisions of clause 2 of the Act. I may point out that, even putting aside altogether the opinion given by our solicitor (a copy of which is enclosed), and allowing that libraries in boroughs do come under the provisions of clause 7, they could not do so until they had actually received the first subsidy granted under clause 2. I beg also most respectfully to draw your attention to the fact that the Act does not confer any power upon Boards to enforce compliance with the provisions of clause 7 after the grant has been distributed. Sic, — I have the honor to acknowledge the receipt of your letter asking my opinion as to whether moneys distributed by the Education Board under section 2 of " The Public Libraries Subsidies Act, 1877," were properly distributed, although some of the libraries receiving such moneys may not have been open to the public free of charge, as mentioned in the seventh section of that Act. I am of opinion that, if the provisions of section 2 of the said Act have been complied with, then the money has been properly distributed. I am further of opinion that the opening of such libraries to the public free of charge under section 7 is not a condition precedent to their obtaining a share of the moneys distributed under section 2.
