FATHER’S DEATH IN ACCIDENT (By Telegram.—(special to Timesl AUCKLAND, Thursday Robert Crawford Smith, farmer, of Te Atatu, appeared before justices in the Police Court today, charged with negligent driving, causing the death of his father, Wm. James Smith. Dr. McElroy represented accused and Mr Goldstine appeared on behalf of Frank Robert Newton, the second driver concerned in the accident. Evidence was given that Newton, a cartage contractor, experienced engine trouble when driving in Great North Road on the night of May 3. He stopped near the corner of Wattle Street, New Lynn, and his truck was struck almost immediately by another truck driven by accused, who had his father as a passenger. In a statement, accused said he did not see Newton's truck until he was within two or three paces of it. He then swerved to the right, but was not able to avoid a collision. Accused pleaded not guilty. He was committed to the Supreme Court for trial, bail being fixed at £IOO.
