RATES INVALID

BUPREME COURT MOTION TUHIKARAMEA RABBIT BOARD Rates levied by the Tuhikaramea Rabbit Board were declared invalid by an injunction granted in the Supreme Court, Hamilton, to-day, by Mr Justice Blair. The applicant " was John Henry Gore (Mr N. S. Johnson) and the hoard (Mr F. A. Swarbrick) did not oppose the application. Mr Swarbrick said the rate had been levied through a technical mistake, and therefore no opposition was made to the motion, as the ratepayers really had a right to upset the rate. His Honour remarked that a great number of small boards could not afford to secure legal advice and as a result sometimes made mistakes. The injunction implies that only the balance of the rates owing, namely £3O, need not be paid. The majority of the ratepayers have already paid their rates, and they will not be entitled to reimbursement without special legislation.
