GARDEN PLACE SCHEME
OPPOSITION TO COUNCIL DEFERRING OF POLL SOUGHT LEGAL ACTION POSSIBLE According to a notice of motion lodged with the town clerk, Mr W. L. Waddel, to-day, Mr W. W. Dillicar will move at the next meeting of the Hamilton Borough Council: “That any further action In connection with the removal of Garden Place Hill be deferred until after the municipal election.'’ The motion will he seconded by Mr H. D. Caro. "The council may be legally right in seeking to proceed with the second poll,” stated Mr Dillicar to-day, --but I think it has broken faith with the ratepayers, since all members of the council agreed to abide by the decision of the 1937 poll. “1* the council at its next meeting decides to go ahead with the poll on t\* restricted area, there is a likelihood that legal action will be taken in the Supreme Court to secure an injunction against the council, preventing the project as planned being carried '•ul.**
