Maunsell, in an important Judgment giving a decision for the Department in a case against the Nelson City Council of employing a gasworks Stoker on Saturday afternoon and not paying the extra rate. The action was brought to test the effect of the Order—in—Councll on the sections stated. The Magistrate considered the effect or the regulation was to modify the section by reducing the rate of additional wages for whole holidays and Sundays from double to time and a—halr. The section. with regards to halt holidays, was not ettected. The charge of reducing wages because of the reduction in working hours was dismissed. Although the stokers previously worked 56 hours the Magistrate ruled that the new rates must be worked on the basis of is, as extra hours were over ‘lme though not paid for.
