DISPUTE OVER SONG COPYRIGHT
| A suit has been filed in New York Supreme Court, by Harry Armstrong and .Richard H. Gerald, authors of “Sweet Adeline," to recover £50,000 from M. Witmark.and Sons, Inc., and Warner Brothers Pictures, Inc., and . Warner Brothers Production Corp. j Plaintiffs allege that in 1930 they contracted with Witmadk to renew the song’s copyright, receiving one-third of any income from possible motion picture use, and holding the right to , pass on any film offers. ! Witmark, 'they claim, never submitted .Warner Brothers’ plan to make j a movie of the .same name, never gave I theta royalties, and allowed the film corporations to advertise the authors of the song as Jerome Kern and Oscar Hammerstein.
