AEROPLANE MISHAP

COLLISION WITH CAR. INCIDENT AT TE RAPA. DAMAGES CLAIM SUCCESSFUL. The reserved judgment in the case in which Ebbett Motors Ltd., of Hamilton, proceeded against the Western Federated Flying Club of New Plymouth, and Kenneth Bartlett, clerk, of Hamilton, for £129 15s 4d damages for alleged negligence following the accident at the Te Rapa Aerodrome on December 10, 1933, when an aeroplane and a new car came into collision, was given this morning by Mr S. L. Paterson, S.M., in the Magistrate's Court, Hamilton. The aeroplane, which was the property of the defendant club, was piloted by Bartlett and when Bartlett was starting it It ran out of control and collided with a new car owned by the plaintiff. In giving judgment for plaintiff for the full amount claimed against Bartlett and allowing the defendant club costs against the plaintiff, His Worship said that on the evidence there ■was no doubt that Bartlett was guilty of negligence. Tho relationship of Bartlett and the Western Federated Club was that of bailor and bailee and not master and servant.
